What is Attendance Allowance?

How do I know if I will qualify?

Attendance Allowance (AA) is a benefit available to people who are in receipt of a State Pension and have some support or supervision needs.
We often get asked the question "how do I know if I will qualify?" Whilst we are not the decision makers (that is DWP) we will have a good understanding of your situation following our initial phone consultation.
If we think it is unlikely that you will qualify, we will let you know immediately.
We don't want to waste yours or our time. We will also let you know what other options are available to you. There is no cost for any of this initial assessment and advice.
If we think you may qualify, we will arrange a home visit/video call/phone call for you/your family member to complete a full assessment and we will complete the application process for you.
If you are successful, you will be awarded the benefit from DWP. 
It is paid every 28 days, normally at the same time as your State Pension.
The high rate (2024) is currently £434.20 every 28 days (high rate). This totals £5644.60 per annum.
It doesn't cost you any of your own money to apply.

What type of support/supervision needs must I have?

I live on my own. Can I still qualify?

Some examples that you need to demonstrate are:


You need some support from someone to get dressed
Someone has to help you with your medication.
You have had some falls
You are a bit unsteady in the shower
You sometimes forget things
It is difficult to get food and drink to a table
You get up in the night for the toilet or you are awake a lot in the night as a result of trying to get comfy due to pain

These are only a few of the examples.

Even is someone does not help you, you can still qualify.

If it takes you a long time to get dressed or you are in pain getting out of a chair are some examples.

Most people will attempt to "carry on and cope" whilst being in pain. You can still qualify if this is you.

An example could be that - due to arthritis in your knees, it takes a long time and it's painful to get upstairs to go to the bathroom. As a result of the time it takes and the pain experienced you would not considered as being able to do this task.

Some peoples conditions and challenges can fluctuate.
DWP states that fluctuating conditions need to be taken into account of when they are at their most challenging.

FAQ's

We've compiled a list of FAQ's to help guide you to your options and choices.

Can the Council complete this for me?

Some councils will have some staff that can complete benefit applications for people. A lot of these positions have gone over the years as councils cut on costs.
You would have to go to their offices with all your paperwork.
We tend to find that some people who complete these processes are under skilled or under motivated to make the claim successful. They will receive their wages whether your claim is successful or not.
If your claim is turned down, you need to wait a further 6 months before you can submit a new claim.
 

Can I complete the application myself?

Yes.
You need to contact DWP and ask them to send you an application form. This needs to be returned to them within 28 days.
Once you see the form, you will see that it can look a bit daunting with 52 areas to complete. 
Statistics from 2023 show that DWP turn down 58% of applications. 
If your application is turned down, you will need to wait 6 months and then present different information to DWP.
In reality, you may have qualified had the form been completed correctly.
As we do this as a No Win No Fee process, why take the risk?

I claim PIP. Can I claim Attendance Allowance as well?

No.
Personal Independence Payment is a similar benefit for people under State Pension age.
Some people may have been assessed for support needs prior to getting to State Pension age.
They carry this benefit into retirement
You cannot be in receipt of both PIP and AA.

I live in a care home, can I still apply for AA?

It depends on your financial situation.
If you are classed as a "self-funder" (you are paying for your own care in the care home) then you are eligible to apply for AA (as long as you are not in receipt of PIP).
If the Government (Council) contribute to your care home costs, you cannot apply for AA as this would indicate that the Government is paying twice towards your care support.

What does no win no fee mean to me?

This means it costs you nothing of your own money.
If we are not successful with your application, it costs you nothing anyway.
If we are successful, we invoice you for 1 month of the award. You do not have to pay this until the money has landed in your bank.
We want you to be very secure and confident in our processes that you will not have to pay anything up front until you are safe and secure in the knowledge that the money is in your bank.
 

How long does it take?

Time can vary, depending on DWP's assessment timings.
Normally however, it is within 8 weeks from start to finish.
Once we receive your call and we have conducted an initial assessment over the phone, we will normally conduct a home visit/Video/call within a week.
The assessment takes around 2 hours with another 2 hours for us once back in our offices quality checking the document.
We send the forms to DWP and normally in around 8 weeks they will have written to you with a decision.
Any award tends to be in your bank account soon after. Your payments from DWP go into your bank on the same day as your State Pension.

I already have an active claim with DWP or another organisation has completed it for me. Can you still help?

If you are already awarded Attendance Allowance and you have a question about it, you need to call the Attendance Allowance help line at DWP on 0800 731 0122.

Unfortunately, unless we have completed the forms for you, we will unlikely be able to help.
We would not have been part of your assessment so we would not have been party to what was written on your claim form.
 

Do you come to my house to complete the application?

 

In the majority of cases yes.
We recognise that we can reduce the stress on individuals by seeing them in their own homes.
Additionally, our assessment is more accurate as we can physically observe you and any equipment that you might use.

For us to be able to complete a home visit, you need to be living within an hour of our head office location (Greater Manchester).

For people who live in different areas of the country - or abroad - see FAQs, we can only offer a video call or telephone appointment.

I don't live within an hour of your location. Can I still get support?

 

 

Yes.
This will depend on your individual ability to use a phone or a computer.
For some people, we may still be able to conduct the assessment.
For some that may struggle using a phone or computer, it may still be possible with the support of a family member or friend who is with you at the time.
All of our consultants are highly trained, patient and knowledgeable.
We acknowledge that discussing personal challenges can be difficult. We try to make the assessment the least intrusive, personal and least stressful as we possibly can.

I have received my decision letter from DWP. It states that I have been given the award for two years and not for life. Why?

Sometimes DWP assessors can determine that they think you may improve within two years and offer a "time limited" award.
This can be for situations where someone may have a temporary condition such as a broken bone and there is an expectation that this may improve within two years.
At around the 18 month point into your award, they will contact you inviting you to re-apply.
If this does happen (it is quite rare) then just make contact with us when you receive the letter and we can support you with a new application.

FAQ's - Claiming from abroad

There is a misconception that if you leave the UK to live abroad, you are no longer entitled to apply for certain benefits.
Please read on to see if can still apply for Attendnace Allowance whilst living in another country.

What countries qualify?

The countries where you are still entitled to apply for some UK benefits, including Attendance Allowance are the EEA countries and Switzerland.
There are 27 in total and include some of the more retired to places such as Spain, France, Italy and Cyprus.

What is the criteria?

It is a little different from applying from the UK but the end process and most of the criteria are the same - see above.

In addition to meeting the Attendance Allowance criteria, you will also need to tick the following:

*You have paid sufficient years into your State Pension (35).
*You are receiving a UK State Pension and you haven't transferred it to a different countries system.
*You have retained UK citizenship (you can be resident in another country but you have not changed your citizenship to that country).
*You meet the criteria of the "Withdrawal Agreement".

 

Withdrawal Agreement

The Withdrawal Agreement, following Brexit was a set of rules drawn up, which included qualifying criteria for multiple laws/rules that would remain in place, or be revoked.
The set date is 31 December 2020.
If you were resident in an EEA country prior to this date, you are able to apply for Attendance Allowance.
Unfortunately, if you moved to an EEA country after this date, you are no longer able to apply for Attendance Allowance, whilst living outside of the UK.

Examples - You retired to Spain in 2014, you are in receipt of a State Pension, have remained a UK citizen and you meet the criteria of needing some support or supervision with your care needs.
You would meet the criteria to apply

You moved to France in 2023. You get a UK State Pension and you now have some support needs as Age has caught up.
You wouldn't meet the criteria. 
This is not because of your support needs but because you moved to an EEA country AFTER the Withdrawal Aggreement date.

Application
 

To start with, we would not be able to complete this with you face to face.
Europe is a big place.
The only option we can offer is to complete your assessment over a video call or by phone.
For some people, you may need support from a friend or family member to help you set this up.

You will need to provide PROOF that you were living in an EU country prior to the Withdrawal Agreement date. This may be in the form of a house purchase, a rental agreement or a letter from a bank as an example.

The additional challenge is for you to sign certain documents that we will have to email you. You will NEED an EMAIL ADDRESS.
You will need access to a printer and a scanner.
We all recognize that it can take months for letters to arrive in the UK for an outside country which can make your assessment fail.

And lastly, as we offer this process as a No Win No Fee, you would need to have a UK bank account to make payment once your Attendance Allowance has been awarded.
Unfortunately, we cannot accept payments in different currencies.
We can only accept bank transfer or card payments from overseas clients, in sterling.
